They are for sale unless marked NFS.
I don't think that they really care too much about sales, it's the entry fees that bring in the $.
I have driven over an hour through horrendous traffic payed my entry fee dropped of the artwork, and then after the event was over I had to drive back again only to discover that the artwork wasn't even included in the exhibition as was damaged as well.
One painting had a huge sharp dent and scratch because it had so many paintings (some of which were heavy) stacked against it.
I was spewing when I saw it and then the moron who dragged it out from behind all of the other paintings said to me "youv'e got to be carefull about that"....what the F##k did I have to do with it?
I couldn't believe how stupid he was.
Another work framed under glass looked like it had been dragged behind a car
That was the Waverly Art Prize by the way.
Dealing with councils is never straight forward so.... you know.... |

Having damaged art work will do that, as will other forms of stress....
I feel like going bald and moving to Shydney...
Instead I am left with long hair and are living in Shitney.... (well not really)
In an ideal world we would be compensated for damage... it hasnt happened that I have heard of yet! |

sorry! been trying to avoid the silly season!
Stefan - ALL works were for sale (although nothing sold, and I was told by another artist later thats perfectly usual...)
I have heard NOTHING from them... except the obligatory - "we are looking into it'...
I've missed the xmas press deadlines because I was being nice and giving them some time (there was a lot of damage to the building and contents so I presume its a huge claim).
But I don't know quite what to do now...
Everything will be closed soon... the silly season will run its course... I don't want them FORGETTING (conveniently)...
So any suggestions would be most appreciated (keep it nice LOL!)

I would suggest you to make contact with them and politely ask them to compensate for the damage. You need to tell them a clear amount you are seeking. If you do this by phone, make a note on what they tell you, time and date of call, who you talked to, any relevant details.
Then ask the same thing in writing.
Then, if nothing happens within a reasonable time frame, you have the option to take them to the small claims tribunal (if you seek less than 5000, I think).
You don't need a lawyer for that. |

| I think its time as artists we draw up our own bit of paper, a document for them to sign, that if any damage is made to our work that they pay any damage fees. If every artist who entered a comp did this we wouldn't have a problem? I think its extreamly unfair that your work has been damaged, and that this happens all the time. Its time we stood up for ourselves.... We should draw up an Australian Exibit Document, for all artists to use when ever they are displaying art work, that makes the persons displaying it have to pay if any damage is made to the work. What really gets me is most of these places we have to pay for them to show our work, or display it, and run the risk of having it damaged....why hasn't someone already thought of this.... |

Cea - that is a GREAT idea! Reallly great! I for one would do that, but we would need the majority on board. If all artists got behind this, there would be no more hassles - the ORGANISER would be responsible for the insurance, which, as and organiser should be a fairly simple matter... after all, event management carries its own insurance and unlike us, they ARE insurable...
I have looked into the insurance dilemma from many angles (there are other threads from me about this) but this idea has merit.
They make us sign agreements, AND take out entry money AND take out commission - so why should we not ask to be insured under their blanket cover as part of all that TAKE?

| That's right tea cat! They really take from us, the exhibition costs the commissions and signing THEIR agreements and they make money out of us, and too bad if our work is damaged...??? This all sounds crazy to me, and Im pretty new at this. I can only imagin how the rest of you feel when you have put up with this for so long. Its time we stood up for ourselves and did something about this. If we ALL took a stand against this type of unacceptable conditions, we could really make a differance to all artists. I had no idea this type of thing could happen untill i read this post and looked further into it. I am so outraged by this crap that i really think I am going to look into starting something for us artists amature or otherwise - We should not put up with being treated this way. We are all selling out if we think that by entering into a "comp" or "exhibition" that will get us noticed and put up with being treated like this. Like the female who says "its ok to sleep with the boss - i will be promoted" its discusting and we all think that right?...well most normal people do, not to mention stupid and how it makes her look? Isn't this is the same thing?.....Who do we talk to? Or can we just write our own conditions? It would be better to have one document that was legal and known to all artist that we all could use....We could call it "The United Artists Agreement of Australia" Or "You Damage - You Purchase" NAVA? What is this? Going to google it now.... |

well......
I opened the mail this morning to a letter stating:
...whilst Council cannot take responsibility for the damage to the artwork due to the prevailing agreement (the one that states they are not responsible etc), in recognition of the unforeseen and difficult natural circumstances that lead to the damage of your painting, Council is willing to make some contribution to the cost of restoration of the artwork.
As part of its investigation, Council sought the opinion of a professional, independent art restorer who estimated the cost to restore the painting as being $200. Council is willing to contribute 50% of these costs.......
WTF? THE so-called RESTORER made this assessment from a #### photograph! That the Council took on the day I picked up my exhibition! The painting CANT be restored! I am so #### angry I decided NOT to contact them yet but wait until I talked to all you guys before deciding my course of action.
$100 to make me go away and shut up...
Which path should I take?

Me personally, would most likely write another letter to them thanking them for their offer and assessment, but as the artist who created the work , and has detailed and personal understanding into the costs and work undertaken to produce the work, in your proffesional opinion it cannot be repaired or restored, and as they have accepted responsibility in the damaged caused by natural unforseeable circumstances , are required to pay x amount of $$ towards the losses incurred from the paintings damage.
Minus the spelling and gramatical errors of course!!
They have accepted responsibility so that is a step in the right direction!!
