In Australia copyright applies for fifty years after the author's death, from what I remember.
Painting in colour after B/W photos (not just colouring them) is, I believe, a substantial change from the original, and it may actually not be an infringement of copyright anyway. |

It used to be that copyright in created works was automatically assigned for the life of the creator plus 50 years after his/her death.
In 2005 this was changed to 70 years.

Well I've just had one of my artworks reproduced in a leading Art Suppliers back to school sale catalogue......no permission, no credit, and no freebies........bit of a strange one but keep reading.....the pic (I think posted in my studio thread) is of a hebel tiki head.....taken in my backyard surrounded by weeds (as I wanted it to be)....now I sold this to someone who happens to be a sales rep for said company....so in theory she should be able to take any photos of the sculpture and use it/ them in what ever way she likes......my problem is the photo used is my photo ripped off my website through google I assume.....splitting hairs I know but hey....I think I should get a %of all sales from the catalogue anyone like my chances? |

What is the correct protocol? I have done a copy of a 17th century Old Masters painting for self-development purposes. There has been some changes made from the original. The painting is not for sale. It's intended to be kept in the family. Is it okay to sign and date it? Or should I indicate on the back of the painting who the original artist was and that it is copied version by myself? Can anyone give me some advice on what is the right thing to do?

I painted a copy of David Davies' Moonrise.
I signed my name then under that put after David Davies
I think that's the correct thing to do.

After David Davies.
It's such a beautiful painting I had to have one hanging in my home.
